General Terms and Conditions (GTC)
1. Scope
(1) These General Terms and Conditions (GTC) apply to all contracts concluded between Zenchenko Svetlana, Gaffelsteig 7, 12527 Berlin (hereinafter referred to as “seller” or “we”) and the customer (hereinafter referred to as “customer” or “you”) for the sale and delivery of goods.
(2) These GTC apply to both consumers (§ 13 BGB) and business customers (§ 14 BGB), unless explicitly stated otherwise.
(3) Any terms and conditions of the customer that differ from these will not be accepted unless we have expressly agreed to them in writing.
2. Conclusion of Contract
(1) The presentation of products on our website or on other sales platforms does not constitute a legally binding offer, but an invitation to submit a purchase offer.
(2) The purchase contract is only concluded once we explicitly confirm your order or ship the goods.
3. Prices and Payment Terms
(1) All prices stated are final prices. According to the small business regulation (§ 19 UStG), we do not charge VAT, and it is therefore not shown.
(2) Depending on availability, the customer may choose from the following payment methods:
- Kreditkarte (Visa, MasterCard, American Express)
- PayPal
(3) Payment is made at the time of placing the order.
4. Delivery and Shipping
(1) Delivery is made to the address provided by the customer.
(2) Shipping costs are communicated to the customer before the contract is concluded.
(3) If a product is not available, we reserve the right to withdraw from the contract. In this case, the customer will be informed immediately and any payments already made will be refunded.
(4) Delivery times may vary depending on the product and destination. Delays due to force majeure or unforeseen events (e.g. supply chain issues) will extend the delivery time accordingly.
5. Right of Withdrawal for Consumers
(1) Consumers have the right to withdraw from the contract within 14 days without giving any reason. The period begins on the day the customer or a person designated by them receives the goods.
(2) To exercise the right of withdrawal, the customer must notify us with a clear statement (e.g. via email or letter).
(3) Return shipping costs are borne by the customer, unless the delivered goods are defective or incorrect.
(4) A refund will be issued within 14 days of receiving the returned goods, provided they are unused and in perfect condition.
Exclusion of the Right of Withdrawal:
The right of withdrawal does not apply to customized or personalized products, or to sealed items not suitable for return due to hygiene reasons if the seal has been removed.
6. Warranty and Liability
(1) The statutory warranty rights under German law apply.
(2) We are liable for defects in the delivered goods in accordance with legal regulations, unless otherwise agreed.
(3) We are not liable for damages caused by improper handling or misuse of the goods.
(4) Liability for simple negligence is excluded, unless essential contractual obligations have been breached.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Data Protection
(1) We process personal data in accordance with our privacy policy and applicable data protection laws (GDPR, BDSG).
(2) Your data will not be shared with third parties without your express consent, unless necessary to fulfill the contract.
9. Dispute Resolution and Jurisdiction
(1) The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr
(2) We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
(3) German law applies. The place of jurisdiction for all disputes arising from this contract is Berlin, provided the customer is a merchant or a legal entity under public law.
10. Final Provisions
(1) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
(2) Changes or additions to this contract must be made in writing.
